PRINCIPAL TERMS
This agreement commences once you have indicated your acceptance during the web sign up process.
This agreement will become binding on you and us as soon as you sign up for your membership, at which point a contract will come into existence between you and us.
You will be entitled to all the rights and privileges set for the Type of Membership chosen.
You cannot transfer this agreement to anyone else
DIRECT DEBIT FEES AND CHARGES
Your membership fees are collected on either the 1st or 15th of the month, depending on your join date. Fees for days between your join date and the next collection date are calculated on a pro rata basis and due for payment at the point of joining. Payment can be made by direct debit or Stripe, a payment service provider.
You agree to advise us immediately of any change to the Members Details provided, in particular, but not limited to, emergency contacts or medical history
DIRECT DEBIT PRICES
From time to time we may need to increase the price of membership. We will give you at least 1 full months' notice of any forthcomingprice increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase. During this period, you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with our notice.
TERMINATION
You may terminate your membership at any point by cancelling your direct debit or Stripe payment. Your membership will remain in place until the day before your next payment is due, at which point it will automatically terminate.
MEMBERSHIP TERMS
Your membership commences as soon as you have competed the web sign up process, or on the date you specified during said process.
You will be entitled to all the services and benefits for the type of membership you have chosen during the sign up process
You cannot transfer this daily membership to anyone else nor transfer to another date.
FEES AND CHARGES
You shall be entitled to cancel your membership on whichever of the following falls first: (1) 14 days after the date of purchase; or (2) the day before the date on which you selected your membership to activate. If you cancel during this period, you will receive a full refund. After this period any paid membership fee is not refundable.
MISCELLANEOUS TERMS
Members must be 16 or older.
There may be occasions where we have to close all, or part of, the gym of which you are a member. We will do our best to let you know of such closures in advance of them taking place, unless the problem is urgent or an emergency. We will use all commercially reasonable endeavours to ensure that such closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part of, or all of, your membership fees in such circumstances.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is outside of our reasonable control.
As a consumer, you have legal rights in relation to any services that are not carried out with reasonable skill and care, or if the materials we use are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights.
We may terminate your membership with immediate effect if you do not adhere to our terms and conditions or behave in a way which is deemed as dangerous to yourself or other members, or use equipment in an unsafe manner.
To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, wellbeing or physical condition. Further, that you will advise us immediately should your circumstances change.
MEMBERSHIP MEDICAL DISCLAIMER
I, agree to participate in a physical fitness program sponsored by Holistic Fitness Club and Blitz Hiit, which may include, but not necessarily be limited to, video guided Hiit training sessions, Private/Semi Private training. Holistic Fitness Club and Blitz Hiit has made me fully aware that the fitness program in which I agree to participate, is of a nature and kind that is extremely strenuous and may push me to the limits of my physical abilities. I recognise and understand that the programme is not without varying degrees of risk which may include, but are not limited to the following:
Injury to the musculoskeletal and/or cardio respiratory system which can result in serious injury or death.
Injury or death due to negligence on the part of myself, my training partner, or other people around me.
Injury or death due to improper use or failure of equipment.
Injury or death due to a medical condition, whether known or unknown to me.
I recognise that there is risk involved in the types of activities offered by Holistic Fitness Club and Blitz Hiit. Therefore, I accept financial responsibility for any injury that I may cause either to myself or to any other participants due to my negligence. I further agree to indemnify and hold harmless Holistic Fitness Club and Blitz Hiit, their employees and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Holistic Fitness Club and Blitz Hiit.
I agree to allow Holistic Fitness Club and Blitz Hiit, its employees and volunteers to use picture(s), film and/or likeness of me for advertising purposes. In the event I choose not to allow use of such media I must inform Holistic Fitness Club and/or Blitz Hiit of this in writing.
I have fully read and understand the foregoing assumptions of risk and release of liability, and I understand that by agreeing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights.
